1. Introduction
These Terms & Conditions (“Agreement”) govern your (“Customer”, “you”, “your”) use of the services provided by United Services Northwest (“Company”, “we”, “us”, “our”). By executing a Service Agreement, submitting an order, permitting us to perform work, or otherwise engaging our services, you agree to be bound by this Agreement. If you do not agree, you may not engage our services.
2. Services
2.1 We provide a wide range of residential and commercial services including, but not limited to, roofing, tree services, landscaping, construction, exterior maintenance, and related property services.
2.2 The specific scope of services, deliverables, timing, pricing, and any special terms will be outlined in a separate written Service Agreement, work order, or quote.
2.3 Any additional or modified services beyond the agreed scope must be confirmed in writing and may incur additional charges.
3. Customer Responsibilities
3.1 You must provide safe and timely access to the property, utilities, permits, and any required approvals (HOA, landlord, municipality).
3.2 You represent that you are the property owner or authorized agent and that all work is lawful. You must disclose any hazardous conditions including underground utilities, unstable structures, or unsafe site conditions.
3.3 You agree to follow any maintenance or care recommendations provided after service completion.
3.4 You will notify us promptly of any issues, damage, or concerns.
4. Pricing, Payment & Cancellation
4.1 Pricing is outlined in your quote or Service Agreement. Payment terms will be specified, and deposits may be required.
4.2 Cancellations within 48 hours of scheduled service may incur a fee.
4.3 Late payments may incur interest.
4.4 We reserve the right to suspend or withhold services for non-payment.
5. Changes to Services & Delays
5.1 Project timelines may be adjusted due to weather, site conditions, access issues, or material availability.
5.2 Changes to scope may result in additional charges and timeline adjustments.
5.3 We are not responsible for delays outside our control.
6. Warranties & Disclaimers
6.1 Services are performed in accordance with industry standards using reasonable care.
6.2 Except where explicitly stated, all warranties are disclaimed to the fullest extent permitted by law.
6.3 We are not responsible for conditions outside our control, including weather, soil conditions, structural issues, or third-party factors.
6.4 Ongoing maintenance is the responsibility of the property owner unless otherwise specified.
7. Limitation of Liability
7.1 Our liability is limited to the amount paid for the specific service.
7.2 We are not liable for indirect or consequential damages.
7.3 These limitations apply to the maximum extent permitted by law.
8. Intellectual Property
All designs, plans, reports, and materials remain the property of the Company unless otherwise agreed in writing.
9. Permits, Codes & Compliance
9.1 The property owner is responsible for permits, approvals, and compliance unless otherwise stated.
9.2 We may assist with coordination, but responsibility remains with you.
9.3 We reserve the right to stop work if unsafe or non-compliant conditions are present.
10. Term and Termination
10.1 This Agreement remains in effect until services are completed.
10.2 Either party may terminate for material breach.
10.3 We may terminate immediately for non-payment, unsafe conditions, or non-compliance.
10.4 You remain responsible for payment of completed work.
11. Maintenance & Ongoing Services
11.1 Ongoing services will be scheduled as needed.
11.2 Missed access or cancellations may result in additional charges.
11.3 Materials and installations may require routine maintenance over time.
12. Safety & Insurance
12.1 We maintain general liability insurance.
12.2 You are responsible for maintaining property insurance.
12.3 Any hazards or damages must be reported promptly.
13. Force Majeure
We are not liable for delays caused by events beyond our control, including weather, natural disasters, or supply issues.
14. Amendments
We may update these Terms at any time. Continued use of our services constitutes acceptance.
15. Governing Law & Dispute Resolution
15.1 Governed by the laws of Washington State.
15.2 Disputes will be resolved through negotiation, then binding arbitration in King County, Washington.
15.3 The prevailing party may recover legal fees and costs.
16. Severability & Waiver
If any provision is invalid, the remainder remains enforceable.
17. Entire Agreement
This Agreement, along with your service documents, constitutes the full agreement.
